What is a birth injury?
Childbirth is a special moment in any parent’s life. However, complications that arise during the delivery of a baby can be frightening. Mothers trust their obstetricians, midwives, nurses and other healthcare providers to identify these complications and treat them quickly to ensure the safety of both the mother and baby. Sometimes, however, mistakes can happen and the baby gets injured.
Birth injuries are harm caused to the baby at and around the time of birth. There are many types of birth injuries and multiple may even occur at once. These injuries can be a consequence of medical malpractice and can result in permanent disabilities for the child. Birth injuries are not always immediately known; delays in the child’s development may not become apparent until they start missing developmental milestones.
Statute of Limitations
Unfortunately, there is a time limit for filing a lawsuit, called a statute of limitations (SOL). This statute varies on a state-by-state basis, and even depending on what type of facility the malpractice occurred in. If you suspect malpractice occurred during birth, it’s important to contact an attorney as soon as possible since birth injury lawsuits can take years to litigate. In Ohio, you have 1 year from the date of the injury to file a parental claim regarding a birth injury case. Claims filed on behalf of the injured child must be made by their 19th birthday.
