How do I know if I have a medical malpractice case for birth injury?
Many birth injuries are preventable. Birth injury attorneys can hold the hospital accountable for failing to prevent these injuries. Whether due to negligence or malpractice, the permanent consequences to your child should not be taken lightly.
Every child’s situation will be different, and birth trauma can lead to several diagnoses at once. The circumstances around a birth injury can involve multiple factors. Our cases often involve things like:
- Hypoxic-ischemic encephalopathy (HIE)
- Cerebral palsy
- A delayed emergency c-section
- Infant seizures
- Umbilical cord problems
- A high-risk pregnancy
- And other birth injuries

How long do I have to file a lawsuit in Illinois?
The time limit for filing a lawsuit is called a statute of limitations (SOL). If you suspect malpractice occurred during birth, it’s important to call us as soon as possible. Birth injury lawsuits can take years to finish.
In Illinois, you currently have eight years from the date of the injury to file a lawsuit.
An Illinois birth injury attorney can verify your statute of limitations. Statutes can change, and they differ based on the state and type of facility where your child was born.
Attorneys at ABC Law Centers: Birth Injury Lawyers work closely with a network of trustworthy attorneys across the country. We will work with co-counsel in Illinois on birth injury cases. Our unique focus on birth injury allows us to provide knowledge on the complicated medical aspects of these cases.
NICU Treatment in Illinois
Babies who experience birth injuries will need treatment from a NICU, or Neonatal Intensive Care Unit. This is a specialized care section of the hospital with equipment for treating infants. The NICU provides supportive services, resuscitation equipment, and treatment for premature babies.
If a child is diagnosed with HIE, most providers will use therapeutic hypothermia, or neonatal cooling. Cooling therapy can help the baby’s brain recover from a brain injury. This treatment can minimize the damage from oxygen deprivation due to trauma during birth. However, there is a short window for this treatment, and the baby must be cooled right after birth.
Several hospitals in Illinois can provide this kind of care for HIE. Level III or Level IV NICUs provide the specialized care that a baby with a birth injury typically needs.
Here is a short list of several hospitals in Illinois with Level III or IV NICU designations:
Level IV:
- Lurie Children’s – Chicago, IL
Level III:
- Advocate Children’s Hospital: Locations in Oak Lawn and Park Ridge, IL.
- Children’s Hospital University of Illinois – Chicago, IL
- UChicago Medicine – Chicago, IL
- Infant Special Care Unit (ISCU) – NorthShore – Evanston, IL
- Loyola Medicine – Maywood, IL
