How long do I have to file a lawsuit?

There is a time limit for filing a lawsuit, called a statute of limitations (SOL). If you suspect malpractice occurred during birth, it’s important to call us as soon as possible. Birth injury lawsuits can take years to finish.

In Georgia, you have until the child’s 7th birthday to file a claim. For an injury to the parent, you have two years from the date of the injury. If the claim is being made against the state, parents have one year to file a claim on behalf of both themselves and the child.
