Michigan Birth Injury Attorneys Win Infant Brain Damage Case for Child with Cerebral Palsy, Intellectual Disabilities & Developmental Delays

The award-winning birth injury attorneys from ABC Law Centers: Birth Injury Lawyers secured a $3.75 million settlement for a child who suffered infant brain damage during birth. The child’s mother missed prenatal appointments throughout her pregnancy and, later in her pregnancy, reported that she hadn’t been feeling the baby move as much. Testing on the day of her delivery at the prenatal clinic revealed that the baby’s movements had become limited, but medical professionals decided that the baby’s health was otherwise normal. The mother was sent to the hospital to induce labor.

The doctor used a drug known as Cytotec to induce labor, but neither the mother or the baby responded well to its effects. The mother’s contractions became too fast and strong (a condition called uterine hyperstimulation). As the mother’s contractions rapidly progressed, the baby suffered from fetal oxygen deprivation. Oxygen deprivation to the fetus’ brain ultimately caused a form of brain damage known as hypoxic ischemic encephalopathy (HIE).

Throughout the case, birth injury attorney Jesse Reiter explained that the baby’s brain damage could have been prevented if the medical professionals had performed an emergency C-section operation earlier in the day. However, medical professionals failed to recognize the need for a Cesarean delivery and instead let several hours pass until the baby was delivered vaginally using forceps. To no avail, the hospital argued that most of the injury occurred before the induction of labor.

Now 10 years old, the girl has been diagnosed with mild cerebral palsy, intellectual disabilities, and developmental delays. She will need lifelong care as a result of the injuries suffered at birth.
