Plaintiff had gestational diabetes. A week before delivery, the fetus was estimated to weigh about eight pounds. However, despite attempts to correct the situation, the infant remained stuck for four minutes. The child was born weighing more than 11 pounds. He suffered brain injury as a result of hypoxic ischemic encephalopathy (lack of oxygen to the brain) and trauma. He has since been diagnosed with Erb’s palsy and cerebral palsy as a result of birth trauma.
