$10.75 Million Settlement for Child with Cerebral Palsy after Medical Negligence at Birth
First time mother of advanced maternal age came to the hospital in labor and was found to be dilated to seven. Despite hours of non-stop contractions, she did not progress to delivery. The attending OB was sleeping in the hospital and the nurse, who was new and had not completed her training before being assigned patients, thought labor was going okay and the baby did not appear to be in distress, so the plan was to continue to vaginal delivery. The baby was eventually delivered by C-section but was so severely brain damaged that she is minimally conscious, with severe cerebral palsy and cognitive deficits. Life expectancy was a major issue in the case.
The case settled for $10.75 million.
