Jesse Reiter of Reiter & Walsh ABC Law Centers has been quoted in the American Association for Justice’s (AAJ) July 21, 2015 online Law Reporter article “Audio Recording of Colonoscopy Reveals Improper Treatment of Patient.” The article details the case of a man whose cell phone accidentally recorded the gastroenterologist who performed the colonoscopy and the assisting anesthesiologist mocking the patient and entering a false diagnosis on his chart. Jesse is quoted as saying:
“As a birth trauma attorney, I have had videos in cases that helped establish the clear facts of what happened, in contradiction to the medical records and the defendant’s testimony, and I’ve also watched as many hospitals banned the use of video recording for prenatal ultrasounds and for labor and delivery. Perhaps health care facilities will attempt to ban audio recording with phones; however, I think that will be extremely difficult given that various state laws about patient and doctor conversations are going to vary drastically.”
The plaintiff in this case was awarded $500,000 by a Virginia jury for defamation, medical malpractice, and punitive damages. As Jesse noted, the attorneys working for the plaintiff say they feel the verdict may lead to healthcare providers attempting to limit their patients’ ability to record conversations.
