Plaintiff was scheduled for an induction of labor because she was 40 weeks and three days pregnant. There were problems during the labor and the attending doctor decided to use a vacuum extractor to assist in delivering the baby. He allowed a first-year resident to perform the procedure, despite problems with the baby's heart rate and the fact that the resident had a poor track record and no experience using such a tool in a delivery.
