Proving Brain Damage
At ABC Law Centers, handling cases across Detroit and the state of Michigan, our brain damage attorneys have years of experience in birth injury law. If medical malpractice or negligence played a role in causing your child’s birth injury, we will prove it. According to a document published in 1992 by the American College of Obstetricians and Gynecologists (ACOG), four elements must be present during or immediately following birth to attribute brain damage to the birth itself. These elements, listed in Technical Bulletin No. 163, include a low pH, low Apgars, seizures, and multiorgan dysfunction. More specifically:
- Profound umbilical artery metabolic or mixed academia (pH less than 7.00)
- Persistence of an Apgar score of 0-3 for more than five minutes
- Neonatal neurologic sequela, (e.g., seizures, coma, hypotonia)
- Multi-organ system dysfunction, (e.g., cardiovascular, gastrointestinal, hematologic, pulmonary, or renal)
