News From Gregory & Reiter, P.C. ABC Law Centers: $3.75 Million Settlement for Child with Mild Cerebral Palsy, Mental Retardation & Developmental Delays

A judge recently approved a $3.75 million settlement between a hospital and our client who suffered brain damage during birth.  The child’s mother missed prenatal appointments throughout her pregnancy.  Late in the pregnancy, she complained that the baby wasn’t moving much.  Testing on the day of her delivery at the prenatal clinic revealed that the baby wasn’t moving as much, but everything else seemed normal.  She was sent to the hospital to induce labor.

 The doctor induced her labor, but neither the mother nor baby responded well to the drug Cytotec that was used for induction.  The baby was not able to tolerate the labor and was not being adequately oxygenated.  The baby suffered from brain damage due to this lack of oxygen.  Detroit birth injury attorney Jesse Reiter explained that the brain damage could have been prevented if doctors had performed a c-section earlier in the day.  Instead, doctors let several hours pass until she was delivered vaginally, with the use of forceps.  The hospital’s position was that most of the injury occurred before the induction. 

 Now 10 years old, the girl has been diagnosed with mild cerebral palsy, mental retardation, and developmental delays.  She will need lifelong care and services as a result of the injuries suffered at birth.
