When a healthcare professional provides medical treatment that deviates from the normal standard of care and it results in damages to a patient, it may be considered medical malpractice. Finally, the plaintiff must show that the deviation from the standard of care caused injury that resulted in damages.

Purpose

The primary purpose of a medical malpractice lawsuit is to recover damages for the victim. The claim also serves to bring it to the court's attention that medical practitioners have acted inappropriately. The plaintiff must provide evidence that damages occurred in the form of increased medical expenses, lost wages, pain and suffering, or mental anguish. In addition to being held responsible for these damages, medical professionals may experience additional consequences related to the claim, such as loss of their medical licenses or increased rates for malpractice insurance.

Claims

Medical malpractice claims can include a wide range of scenarios. For example, errors during the labor and delivery process could result in brain injury, Erb's palsy, cerebral palsy, or other conditions. In addition to birth injury claims, other common types of medical malpractice include prescription errors, surgical errors, misdiagnosis, and nursing home abuse or neglect.
